The government approved new rules for determining the customs value of goods exported from Russia. The corresponding resolution of 16.12.2019 No. 1694 is published on the Official Internet portal of legal information.
The document establishes the procedure for determining the customs value of exported goods, as well as the features of the application of various methods for determining the customs value provided for by the EAEU Customs Code.
According to the rules, the customs value of exported goods is determined in order to calculate export customs duties, the basis for the calculation of which is the customs value of exported goods. At the same time, the customs value of exported goods is not determined and is not declared if, in accordance with the EAEU law and Russian legislation, there is no obligation to pay export customs duties and the calculation is based on their customs value in relation to exported goods.
The new rules for determining the customs value of goods will enter into force on January 23, 2020. Accordingly, the current rules for determining the customs value of exported goods, approved by Decree of the Government of the Russian Federation dated 06.03.2012 No. 191, are abolished.
As previously explained by the Ministry of Finance, the update of the rules is associated with the adoption of a new law on customs regulation (dated 03.08.2018 No. 289-ФЗ) and the entry into force of the Treaty on the Customs Code of the Eurasian Economic Union.
