Rostrud experts clarified whether the employer should issue a separate personnel order to pay for hours worked above the norm.
The Office notes that the current legislation does not establish the obligation of the employer to issue an order for employees to pay overtime work.
However, according to Rostrud, it is advisable to put this issue in a separate position in the operative part of each order on attracting an employee to work outside the established working hours.
Also, the employer is not obliged to acquaint employees under signature with the total number of hours worked by them in excess of the norm for the year. This is not required, unless otherwise provided by the collective agreement or local regulatory act. The employer can conduct this familiarization at his discretion and is obliged to conduct it upon receipt of an application from the employee.
