Laws on the transition to electronic work books published

Russian President Vladimir Putin signed laws that establish the ability to keep information about the work activities of workers in electronic form.

Federal Law of December 16, 2019 No. 439-FZ contains amendments to the Labor Code of the Russian Federation. They establish the possibility of entering information on employment in electronic form. According to the new provisions, information in electronic form will be the basic information about the employee’s work and work experience, including information about the employee, the work performed by him, transfers to another permanent job and the dismissal of the employee, as well as the grounds for termination of the employment contract. This information will be submitted by employers to the information system of the Pension Fund of the Russian Federation.

Federal Law of 16.12.2019 No. 436-FZ amends the law on individual (personified) accounting (dated 01.04.1996 No. 27-FZ). Starting January 1, 2020, it introduce a new obligation for employers who will submit information on the labor activities of insured persons to the pension fund information system.

From January 1, 2021, employers of the choice of the employee will be able to keep work books in electronic form. Until June 30, 2020, employers are required to notify each employee in writing of the right to choose between a paper or electronic work book. Accordingly, until December 31, 2020, each employee will be able to submit a written application to the employer about which form of maintaining the work book he chose, but if the application was not submitted, the employer will continue to keep the work book in paper form.

For persons first entering work after January 1, 2021, all information will be kept in electronic form, and they will not be issued a paper labor book.

These federal laws will enter into force on January 1, 2020.
