On August 6, Federal Law No. 221-FZ of July 26, 2019 entered into force, which established the administrative responsibility of employers for “salary slavery”. The text of the law can be found on the Official Internet portal of legal information.
Amendments to Art. 5.27 of the Administrative Code of the Russian Federation allow employers to be fined for preventing the employee from exercising the right to change the bank to which his salary is transferred.
According to the law, salary can be transferred to a credit institution indicated in the employee’s application. At the same time, the employee is entitled at any time to replace the credit institution to which his salary is transferred. An employer is not entitled to prevent its employees from choosing a bank in which they want to receive their salaries.
If the employer begins to impede the exercise of the right to change a credit organization, now he will be fined under part 6 of article 5.27 Administrative Code of the Russian Federation. The fines under this article are assigned in the following sizes:
- from 1,000 to 5,000 rubles – for individual entrepreneurs;
- from 10,000 to 20,000 rubles – for officials;
- from 30,000 to 50,000 – for organizations.
