Rostrud clarified whether the employer has the right to transfer employee wages to another person.
In its letter dated 10.16.2019 No. ТЗ / 5985-6-1, the department notes that upon the requirement of article 136 of the Labor Code of the Russian Federation, salaries are paid directly to the employee, unless otherwise provided by federal law or an employment contract.
Accordingly, in the opinion of Rostrud, the employer has the right to transfer the employee’s wages to another person, if the specified wage condition is contained in the labor contract concluded with the relevant employee.
If such conditions were not provided for by the labor contract, then an agreement must be concluded in writing with the employee on changing the terms of the labor contract regarding the method of payment of wages.
